PROGRAM OVERVIEW

The downturn in the agricultural economy has brought a series of challenges for both farmers and their lenders. This presentation will discuss best practices in a troubled agricultural economy regarding making loans, managing performing credits, managing troubled credits, handling preliminary workout discussions, handling priority disputes with other creditors, and navigating through the farmer lender mediation process.

Learning Objectives:
  1. Understanding additional steps and practices that should be taken in making agricultural loans in troubled times, versus in good times.
  2. Understanding additional steps and practices that should be taken in managing performing credits and monitoring financials in troubled times, versus in good times.
  3. Understanding the dos and don’ts of dealing with borrowers who are either in default, or showing significant signs of strain.
  4. Understanding all the tools that exist in the workout tool belt, along with how to effectively use each tool.
  5. Understanding the competing agricultural liens created under Minnesota law, along with the circumstances surrounding when said liens have priority over the bank’s liens.
  6. Understanding what to expect in the Farmer-Lender Mediation process.

PRESENTER

Matthew Bialick is an attorney with the law firm of Johnson | Bialick. and provides transactional, advisory and workout/litigation support to banks of all sizes. In addition to providing support on general commercial matters, he provides representation and advisory support on agricultural workout matters, agricultural finance matters and matters involving lending limit issues. Matthew graduated magna cum laude from the University of Minnesota law school. Prior to law school, Matthew attended the honor’s program at University of Minnesota’s Carlson School of Management, where he graduated first in his class, summa cum laude and with high distinction.
